Terms & Conditions

TERMS AND CONDITIONS FOR MARIAN’S LIST CANDIDATES (the “Terms”)

issued by the company Marians List s.r.o., ID No.: 23050471, with its registered office at Karolinská 654/2, 18600, Prague 8, Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague, File No. C 420585 (the “Marian’s List” or “us”).

  1. INTRODUCTORY PROVISIONS

    1. Subject of the Terms. These Terms are a contract between us as Marian’s List and the Applicant who has chosen to apply for employment through Marian’s List (the “Applicant” or “you”).

    2. Conclusion of the Terms. The Agreement is concluded at the moment of sending the form or request of the Applicant, if the Terms are referred to. Without agreeing to the Terms, it is not possible to properly use our Services.

  2. SERVICE

    1. Marian’s List Services. We collect contacts and personal data from you as an Applicant so that we can connect you with quality companies that are interested in finding relevant job positions. In our system, you do not apply to specific employers, but we always assign them to you according to the suitability of the offers, it is common for several employers to be involved at the same time (the “Services”).

    2. Transfer of your personal data. Whenever we transfer your personal data to an employer, we will first request your consent. We will not transfer your personal data to the employer without your consent.

    3. Sending offers. We send you offers in accordance with Articles 2.1 of these Terms. We personalize job offers according to the data you have entered, only offers based on your preferences will be sent to you. Marian’s List is not obliged to verify the data if it is not real, and Marian’s List is not responsible for sending inappropriate job offers.

    4. Free of charge Services. All Services provided to Applicants are free of charge.

    5. Use of artificial intelligence. We may use artificial intelligence to provide the Services, but not for automated decision-making or profiling. More information on this is provided in the Privacy Policy.

    6. Accuracy of data. You are responsible to us for the accuracy of the data provided in connection with the performance of the Agreement. If any of them change, you can notify us so that we can update them. This is especially important for us to send suitable job offers.

  3. PROCESSING OF PERSONAL DATA

    1. Processing of personal data. We process all your personal data in accordance with legal regulations, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR). All information regarding the processing of personal data can be found in our Privacy Policy.

  4. DURATION OF THE TERMS AND THEIR TERMINATION

    1. Duration of Terms These Terms are concluded for an indefinite period.

    2. Termination of Terms. You may terminate these Terms at any time without notice. You may terminate by sending an email to info@marianslist.com or send your notice to our address Varšavská 715/36, Vinohrady, 120 00 Prague 2, Czech Republic.

    3. Termination of sending job offers. If you decide to terminate this Agreement, we will stop connecting you with employers and otherwise sending you job offers. However, termination of this Agreement does not affect any negotiations with employers that we have validly entered into during the term of the Agreement, which are no longer under the control of Marian’s List and are not performance of this Agreement.

    4. Complaints. We provide out-of-court settlements of consumer complaints through email info@marianslist.com.

    5. Out-of-court dispute resolution. The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, Company ID: 000 20 869, internet address: https://coi.gov.cz/en/information-about-adr, is responsible for the out-of-court resolution of consumer disputes against entrepreneurs. The European Consumer Centre Czech Republic is also located at this address, internet address: https://evropskyspotrebitel.gov.cz/en, which is the point of contact for consumers in the EU.

  5. FINAL PROVISIONS

    1. Prohibition of misuse of Marian’s List Services. You undertake not to misuse the Marian’s List Services or use them for any purpose other than their intended purpose (i.e. in particular searching for or monitoring job positions). If misuse occurs, we are entitled to recover any resulting property damage and non-pecuniary damage.

    2. Liability for outage of Marian’s List Services. We are not liable for any outage of Marian’s List Services if it is due to force majeure, a technical error or other unforeseeable event that affects our provision of the Services.

    3. Governing law and jurisdiction. The legal relationship between us will be governed by the law of the Czech Republic. This also applies in the event of the existence of a so-called international element, when the norms of private international law and relevant international conventions are excluded. However, we are aware that the customer-consumer cannot be deprived of the protection provided to him by this choice by the provisions of the law of the country where he has his habitual residence. The court with subject-matter and territorial jurisdiction for these Terms will be the court with subject-matter jurisdiction for Prague. This does not affect the rights of consumers under special legal regulations.

    4. Date of effect of Terms. These Terms are valid and effective from info@marianslist.com.
